Clear expectations before paid work begins.

The commercial terms for projects, deposits, cancellations, payments and ongoing management.

Effective 12 August 2026. An accepted proposal may add project-specific terms and takes priority where stated.

Enquiries and project acceptance

Submitting a questionnaire or contact form asks ADE Forge to review the opportunity. It does not reserve capacity, create an accepted project or require payment. A project begins only when the applicable proposal or written agreement is accepted and any required deposit is paid.

Proposal and scope

The accepted proposal records the agreed deliverables, exclusions, price, timing assumptions and payment stages. Work outside that scope may require a written change, a revised proposal or an additional payment. Estimates and schedules may change when the client changes scope, delays feedback or does not provide required material.

Deposits

A deposit reserves production capacity and allows project work to begin. Once paid, the deposit is not refundable if the client changes their mind, cancels the project, chooses not to continue or does not provide the information, access, content, feedback or approvals needed to proceed. ADE Forge may retain the deposit against reserved capacity, administration and work already performed.

Project cancellation

A client may tell ADE Forge in writing that they do not wish to continue. The project will stop at a reasonable point after the notice is received. The deposit remains retained and the client must pay any other amount already due for completed work, approved third-party costs or work performed beyond the value of the deposit. Any unused amount is handled according to the accepted proposal and applicable law.

Payments and late payment

Payment requests are issued through the client workspace and may be completed through Stripe. Work, launch, transfer, access or further services may be paused while an amount is overdue. Stripe and other payment providers may apply their own terms and processing requirements.

Client responsibilities

The client must provide accurate instructions, timely feedback, requested approvals and access needed for the project. The client confirms that it has the right to use all supplied text, images, branding, data and other materials, and that the requested website content and business activity are lawful.

Approvals and delivery

An approval recorded in the client workspace or otherwise given in writing may be relied on by ADE Forge. Delays caused by missing client decisions or materials may move the delivery schedule. A project is complete when the agreed deliverables have been supplied or made available, subject to any separate defect or support obligations.

Ownership and third-party services

Unless the accepted proposal says otherwise, ownership of bespoke final deliverables transfers after all project amounts are paid. ADE Forge retains ownership of its pre-existing tools, methods and reusable components. Domains, hosting, fonts, software, integrations and other third-party services remain subject to their own licences, fees and terms.

Ongoing management

Recurring management includes only the services described in the management offer. Each management subscription has a three-month minimum commitment unless a different written term is agreed. After the minimum term, the client may request cancellation at any time through the client workspace. Cancellation takes effect at the later of the end of the current paid billing period and the end of the minimum term. Charges already processed for a current period are not refunded merely because the client no longer wishes to use the service.

Management changes

ADE Forge may propose a change to the management price or included services. The current subscription remains unchanged unless the client accepts the proposed change. The client can decline the proposal and continue on the existing arrangement unless ADE Forge separately gives notice that the existing service will end.

Consumer rights and refunds

Nothing in these terms excludes, restricts or modifies a right or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law. A no-refund or deposit-retention term does not apply where the law requires a refund, repeat performance, compensation or another remedy because of a failure by ADE Forge.

Liability

To the extent permitted by law, ADE Forge is not responsible for indirect loss, lost profit, lost opportunity or interruption caused by third-party services, client-supplied material, unauthorised changes, security incidents outside reasonable control or use of the deliverables outside the agreed purpose.

Changes and governing law

These website terms may be updated for future enquiries and services. An accepted proposal remains governed by the version and additional terms accepted for that project. These terms are governed by the laws applicable in New South Wales, Australia.
